Commentaire de l'arrêt de Cass. 3ème civ., 10 octobre 2019, Samuel Guillaume

Administrer, novembre 2019

A tenant which, during the lease, enjoyed quiet possession of parking spaces and no longer has the benefit of them suffers, from the time of that deprivation, a loss arising from the reduction in the value of its business deprived of any private parking, which must be compensated, even if the tenant does not show how the landlord’s partial failure to perform its obligation to deliver the premises jeopardises its business operations.
